Terms and Conditions

1. General Provisions

1. These Terms and Conditions define the conditions for car rental offered by AZRA Automotive, based in Warsaw (hereinafter: “Lessor”, “AZRA”).
2. The Lessee may be an individual or legal entity who has accepted these Terms and Conditions and meets the requirements outlined in section 2.
3. Making a reservation or signing a rental agreement constitutes acceptance of these Terms and Conditions.

2. Lessee Requirements

1. The Lessee must hold a valid Category B driver’s license for at least 2 years.
2. The minimum age of the Lessee is 25 years. For selected premium models, the minimum age may be 30 years.
3. The Lessee is required to present a valid identity document (ID card or passport) and driver’s license for verification.
4. AZRA reserves the right to refuse rental without stating a reason.

3. Reservation

1. Reservations can be made through the website, by phone, or in person at AZRA’s office.
2. A reservation is confirmed upon receipt of the reservation deposit in the amount specified at the time of booking.
3. AZRA reserves the right to offer a replacement vehicle of equivalent or higher specifications if the reserved model is unavailable.
4. Free cancellation is available up to 48 hours before the scheduled vehicle pick-up. For later cancellations, the reservation deposit is non-refundable.

4. Vehicle Pick-Up and Return

1. Vehicle pick-up and return takes place at a location agreed upon with the Lessor. Vehicle delivery within Warsaw is free of charge.
2. Upon pick-up, a handover protocol is prepared describing the technical and visual condition of the car. Both parties confirm the protocol with their signature.
3. The Lessee is obligated to return the vehicle in a condition no worse than normal wear and tear, at the time and location specified in the agreement.
4. Late return without prior arrangement results in a charge of 150% of the daily rate for each day or part thereof of the delay.

5. Fees and Payments

1. Rental prices listed on the website are gross prices (including VAT).
2. Payment for the rental is made in advance, before the vehicle is released, unless otherwise agreed by the parties.
3. Accepted forms of payment: bank transfer, cash, payment card.
4. A refundable deposit is collected upon vehicle pick-up. The deposit amount depends on the vehicle class and is specified in the rental agreement. The deposit is refunded upon return of the vehicle in proper condition.

6. Insurance and Liability

1. All AZRA vehicles carry valid third-party liability insurance (OC), comprehensive insurance (AC), and personal accident insurance (NNW).
2. Comprehensive insurance includes a deductible as specified in the rental agreement. The deductible may be waived for an additional fee.
3. Insurance does not cover damage resulting from:
   • driving under the influence of alcohol or intoxicating substances,
   • gross violation of traffic regulations,
   • use of the vehicle contrary to its intended purpose,
   • making the vehicle available to unauthorized persons.
4. The Lessee bears full responsibility for all fines, parking fees, and other penalties incurred during the rental period.

7. Vehicle Use Rules

1. The Lessee is obligated to use the vehicle in accordance with its intended purpose, traffic regulations, and manufacturer’s recommendations.
2. The following are prohibited:
   • smoking tobacco and using e-cigarettes in the vehicle,
   • transporting animals without prior consent of the Lessor,
   • towing other vehicles,
   • participation in races, rallies, or test drives,
   • subletting the vehicle to third parties,
   • taking the vehicle outside Poland without written consent of the Lessor.
3. The vehicle may only be driven by the person designated in the rental agreement as the Lessee or additional driver.

8. Fuel and Mileage Limits

1. The vehicle is provided with a full tank of fuel. The Lessee is obligated to return the vehicle with a full tank. If returned with less fuel, a charge for the missing fuel plus a service fee of 50 PLN net will be applied.
2. The daily mileage limit is 300 km, unless otherwise specified in the agreement. An additional fee as specified in the rental agreement is charged for each excess kilometer.

9. Breakdowns and Accidents

1. In the event of a breakdown, accident, or vehicle theft, the Lessee is required to immediately notify the Lessor and the appropriate authorities (Police in case of an accident or theft).
2. In the event of a breakdown preventing further driving, AZRA will provide roadside assistance and — subject to availability — a replacement vehicle.
3. The Lessee is required to document the incident with photographs and obtain the details of other parties involved (in case of a collision).

10. Damages and Contractual Penalties

1. For damages caused by the Lessee that are not covered by insurance, the Lessee bears full financial responsibility.
2. Interior cleaning fee (soiling beyond normal wear): from 500 PLN to 2,000 PLN depending on the extent.
3. Smoking in the vehicle fee: 2,000 PLN.
4. Loss of vehicle keys: cost of replacement + possible lock replacement, according to the manufacturer’s price list.

11. Personal Data Protection

The rules for processing Lessees’ personal data are outlined in the Privacy Policy available on the AZRA website.

12. Complaints

1. Complaints regarding rental services can be submitted in writing to the email address: azraauto.corp@gmail.com or by phone: +48 573 433 818.
2. Complaints will be processed within 14 business days of receipt.

13. Final Provisions

1. In matters not regulated by these Terms and Conditions, the provisions of the Polish Civil Code and other applicable Polish law shall apply.
2. Any disputes shall be resolved by the court having jurisdiction over the Lessor’s registered office.
3. AZRA reserves the right to amend these Terms and Conditions. Lessees will be informed of significant changes on the website.
4. These Terms and Conditions are effective from March 1, 2026.
